Privacy Policy
This Privacy Policy explains how SmartScale Solutions (“SmartScale”, “we”, “us”) collects, uses, stores, and protects your personal data when you visit our website or contact us. We process personal data in accordance with India's Digital Personal Data Protection Act, 2023 (the “DPDP Act”) and applicable rules.

1. What personal data we collect
When you submit our contact or “free audit” form, or otherwise reach out to us, we collect the information you provide, which may include:

We do not knowingly collect more than you choose to share. We do not run advertising trackers, and our website does not set marketing cookies.
2. How we collect it
We collect personal data directly from you when you complete a form on our website or contact us by email, phone, or social media. Our website forms are processed through our form-delivery provider (see Section 6).
3. Purpose and use
We use your personal data only to:
- respond to your enquiry and provide the free audit or information you requested;
- communicate with you about our services where you have asked us to;
- provide and improve our services if you become a client;
- comply with legal and regulatory obligations.
We will not use your data for unrelated purposes without your consent.
4. Legal basis (consent)
Under the DPDP Act, we process your personal data on the basis of the consent you give when you voluntarily submit your details to us, for the purposes described above. You may withdraw your consent at any time (see Section 9); withdrawing consent does not affect processing already carried out.
5. Sharing and disclosure
We do not sell or rent your personal data. We share it only with:
- Service providers (Data Processors) who help us operate, such as our form-delivery and hosting providers, who process data on our instructions under confidentiality obligations;
- Authorities, where disclosure is required by law or to protect our legal rights.
6. Where your data is processed (cross-border transfer)
Our website is hosted on Vercel, and form submissions are delivered through Formspree. These providers may store or process data on servers located outside India. We rely on reputable providers that apply appropriate security measures, and we transfer data only as permitted under the DPDP Act and applicable rules.
7. Data retention
We keep your personal data only for as long as necessary to fulfil the purpose for which it was collected, to maintain our business relationship, or to meet legal obligations. When it is no longer needed, we securely delete or anonymise it.
8. How we protect your data
We apply reasonable security safeguards, including encryption in transit (HTTPS/TLS), access controls limited to staff who need the data, multi-factor authentication on key accounts, and secure credential storage. No method of transmission or storage is completely secure, but we work to protect your information and to respond promptly to any incident.
9. Your rights as a Data Principal
Under the DPDP Act, you have the right to:
- Access a summary of the personal data we hold about you and how we process it;
- Correction and updating of inaccurate or incomplete data;
- Erasure of your personal data, where it is no longer required;
- Withdraw consent at any time;
- Grievance redressal from us (see Section 10);
- Nominate another individual to exercise your rights in the event of death or incapacity.

If you are not satisfied with our response, you may have the right to lodge a complaint with the Data Protection Board of India.
11. Children
Our website and services are intended for businesses and are not directed at children. We do not knowingly collect personal data of children (individuals under 18) without verifiable parental or guardian consent as required by the DPDP Act.
12. Changes to this policy
We may update this Privacy Policy from time to time. The “Last updated” date at the top shows when it was last revised. Material changes will be reflected on this page.
13. Client store data accessed through Amazon
If you are a client and you authorize our app, SmartScale Seller Hub, in Seller Central, or you give us access to your advertising account, we access business data from your seller account through Amazon's Selling Partner API and Amazon Ads API. This section explains how we handle that data.

| Changes we make | Through the Selling Partner API we only read your store data; we never change listings, prices, inventory or orders. If you engage our advertising management service, we also make advertising changes in your Amazon Ads account on your behalf, such as negative keywords, bids, budgets and campaign settings. Every change is recorded with the date and the person who made it, and we can provide that record on request. |

We handle this data in line with our agreement with you and with Amazon's Acceptable Use Policy and Data Protection Policy for developers.
